TERMS OF USE FOR QICKBACKBALL

1. Introduction

This document constitutes the complete terms of use for Qickbackball and for all services provided by QBB Sport AB (reg. no. 559493-5958). The terms govern the relationship between you as the user and us as the provider of the website, products, digital material and applications connected to Qickbackball. By accessing or using any part of our website, app or services, you agree to be bound by these terms in their entirety. If at any time you do not consent to these terms, we ask that you refrain from continuing to use the services, as use without acceptance is not permitted.

2. Use of the Service

To use our services in a correct and lawful manner, you must either have reached the legal age of majority in your country of residence or have obtained consent from a legal guardian. You are responsible for all activity that takes place under your account or through the use of our services. Any form of unauthorised use is prohibited, including—but not limited to—attempts to disrupt website functionality, bypass security mechanisms, spread malicious code, or use the services for fraudulent or otherwise unlawful purposes. If you breach these provisions, we reserve the right to immediately suspend or permanently terminate your access to the services.

3. Accuracy and Completeness of Published Information

We always strive to present information that is accurate, up-to-date and transparent. Despite our efforts, spelling errors, technical issues or other circumstances may occur which cause certain information to appear with discrepancies. This may concern product descriptions, pricing, stock status or digital features. All information on the website is provided for informational purposes and we cannot guarantee that it is always complete or that it perfectly reflects final product specifications. We reserve the right to correct errors, update information or change content at any time without prior notice.

4. Changes to Services and Prices

Qickbackball is continuously evolving, which means that our products, services and digital features may be updated, modified, expanded or removed over time. This may occur without notifying users beforehand, and we are not responsible for any consequences this may entail for you as a customer. Prices may be adjusted due to market conditions, shipping costs or promotional campaigns, and such changes may occur at any time.

5. Product Information and Delivery Contents

QickBackBall functions as an innovative training device developed to improve football technique, reaction ability and ball control. When making a purchase, you receive a complete package consisting of the training ball itself, an adjustable waist belt, a pump, a gym bag, and a QR code that grants access to our digital content and app. In some cases, the product may vary slightly in colour, material or details compared with the images on the website due to production variations or technical differences between screens.

6. Orders and Payment Processing

When placing an order, you are responsible for ensuring that all personal information and delivery details are correct. If we suspect inaccuracies, fraud or irregularities, we reserve the right to contact you for verification or cancel the order entirely. All payments are handled through Shopify and their authorised payment partners, ensuring that your payment information is processed securely and encrypted.

7. Digital Content and Application

When purchasing, digital content is included in the price and accessed through our mobile application. The app’s functionality is affected by your device’s hardware, software and microphone quality. As the app is based on audio analysis to calculate hits, performance may vary in noisy environments or on older devices. The content and features of the app may be updated continuously, where certain functions may be added while others are removed.

8. Third-Party Services

To deliver a high-quality and secure service, we use external third-party solutions such as web hosting, statistics, analytics, payment processing and technical maintenance. Each third-party provider is responsible for its own infrastructure and its own terms, which means that their respective policies apply to the services they provide.

9. Deliveries

Qickbackball initially offers deliveries within Europe, with the ambition to eventually deliver globally. As deliveries are handled by external transport companies, we cannot be held responsible for indirect costs or damages that arise due to delays caused by factors beyond our control, such as logistics issues, strikes or natural events.

10. Comments, Reviews and User-Generated Content

All material you voluntarily submit to us—such as reviews, images, ideas, suggestions or comments—may be used by us without limitations and without any obligation to compensate you. You are responsible for ensuring that all content you provide is lawful and does not infringe the rights of third parties.

11. Prohibited Conduct

It is prohibited to use our website in a way that aims to harm, impersonate, mislead or disrupt the business, technology or other users. This applies particularly to attempts to hack, manipulate systems or collect data without explicit permission.

12. Limitation of Liability

All services and products are provided “as is”, without warranties beyond those required by law. We are not liable for indirect damages, consequential damages, financial losses or any other damage that may arise in connection with the use of our services.

13. Liability for Damages

If you violate these terms or cause damage through improper or unauthorised use, you may be held liable for costs, damages and legal expenses incurred by us.

14. Termination of Service

You may discontinue the use of our services at any time. In the event of violations of the terms, we reserve the right to immediately terminate your access without further notice.

15. Governing Law and Disputes

Swedish law shall apply to the interpretation and application of these terms. Any disputes shall primarily be resolved through dialogue with our customer service.

RETURN AND REFUND POLICY
Our aim is to provide you as a customer with a safe and smooth shopping experience. At the same time, we must ensure that the return process is handled in a way that protects both you and our company. Therefore, you must always contact us at support@qickbackball.com before sending a product back. This helps prevent lost shipments, incorrect returns, and unnecessary costs.

A return may be approved if the product is in completely unused condition and all accessories and packaging are intact. In other words, the product must be in the same condition as when it was delivered, with no signs of use or damage. Unopened packaging is essential, as the product loses value once opened or used.

For approved returns, we refund the cost of the product, but shipping costs are not refunded. You are responsible for the return shipping, and we strongly recommend using a tracked shipment since we cannot compensate for lost packages. If a return is sent without tracking, you as the customer bear the risk. A return fee of 8 Euro will be charged for each return to cover handling costs.

Refunds are processed after we have received and inspected the product. They are usually handled within five to ten business days. If the refund is delayed, you should first contact your bank or card issuer, as their processing times often affect when the funds appear in your account.

If you do not collect a package from a pick-up point and it is returned to us, we charge a fixed fee of 45 Euro. This covers the carrier’s return fees, storage handling, and administrative time. Such a return is not considered a withdrawal (right of withdrawal) return.

In cases of damaged or defective products, we will of course replace the item. Contact us and we will assist you through the process. If the product was purchased as a gift, the recipient may in some cases receive store credit instead of a refund to the purchaser.


PRIVACY POLICY (GDPR)
QBB Sport AB is committed to protecting your personal privacy and processes your personal data in accordance with the General Data Protection Regulation (GDPR). When you shop with us, use our website, or interact with our app, we collect information necessary to deliver products, provide support, and improve our service.

We process data such as your name, address, phone number, email address, order information, IP address, device data, and statistics on app usage. In some cases, technical logs and error reports are also collected to improve app stability and performance. This information is used to administer orders, manage deliveries, provide customer service, further develop the service, and comply with legal obligations, such as accounting requirements.

To protect your data, we implement both technical and organizational security measures. We use established third-party providers for payment solutions, hosting, and analytics. These partners process data according to agreements and may not use it for purposes contrary to our instructions.

You have the right to request access to the personal data we store about you, request correction of inaccurate data, request deletion in certain cases, restrict processing, object to specific processing, and request data portability in a structured, commonly used, and machine-readable format. APP PRIVACY POLICY
The Qickbackball app is designed to provide you with an interactive training experience linked to our product. For the app to function optimally, certain technical information about your device and app usage is processed. The app uses the microphone to register hits on the football through sound analysis. This processing occurs in real time and is solely intended to count hits and enhance the training experience—not to record or save conversations.

In addition to sound analysis, the app may collect data such as device type, operating system, IP address, usage patterns, and crash reports. This information helps us understand how the app is used, identify bugs, and improve performance. For these purposes, we may use third-party services such as Google Play Services, Firebase Analytics, and Firebase Crashlytics, which provide tools for analytics and crash reporting.

We take reasonable technical and organizational measures to protect the data processed through the app. Since certain parts of the functionality rely on external providers’ infrastructure, their privacy policies apply alongside ours.
